Although its initial decision was overlooked by a local court, the Constitutional Court once again ruled a violation since its ruling was not applied for the jailed city planner Tayfun Kahraman, finding that its earlier decision had not been implemented.
Despite a Constitutional Court ruling that his right to a fair trial had been violated, the Istanbul 13th High Criminal Court rejected on Nov. 6 a retrial for Tayfun Kahraman, an urban planner imprisoned in the Gezi Park case.
Talent manager Ayşe Barım, on trial for allegedly attempting to overthrow the government in connection with the 2013 Gezi Park protests, was briefly granted conditional release under judicial supervision—until an upper court overturned the ruling and issued a new arrest warrant just as she was about to undergo a medical procedure.
The Constitutional Court ruled that Tayfun Kahraman’s right to a fair trial was violated and ordered a retrial. The decision was made by majority vote.
