Turkey’s Constitutional Court has ruled that former HDP MP Hüda Kaya was unlawfully arrested and that her rights were violated after she was denied access to her file following her detention over the 2014 Kobani protests.

The court ruled that Historical Traffic Search (HTS) records—mobile phone signal logs showing who contacted whom, when, for how long, and via which base station—do not reveal the content of the communication in question and therefore cannot be used as the sole basis for arrest.

The court awarded Kaya non-pecuniary damages of 200,000 lira.

Kaya, an HDP MP at the time, was investigated and arrested on charges of making PKK propaganda and inciting the public to take part in the protests on Oct. 6-8, 2014.

Kaya filed an individual application with the Constitutional Court after the Ankara 22nd High Criminal Court ordered her release on June 25, 2024.
